Request submission procedure

Public information is provided by the Ministry of Ecology and Natural Resources of Ukraine in response to the information request.

Request for information is the request of person to administrator of information to provide public information being possessed by such person (part 1 Article 19 of the Law of Ukraine "On Access to Public Information").

In accordance with the Law of Ukraine "On Access to Public Information" the Ministry of Ecology and Natural Resources of Ukraine is an administrator of public information that was received or created in the process of exercising the powers stipulated by laws and is within the competence of the Ministry.

The Order of MENR of 02.06.2011 # 186 identified the PR and Communication Division as a structural division for requests for public information and the said division is an administrator of such information.

Request for information is submitted by individual or legal entity, association of citizens without status of legal entity in verbal or written form during personal reception or through mail, electronic mail, telefax or by phone.

Request for information can be submitted directly to the PR and Communication Division daily from 9.00 till 18.00, on Friday from 9.00 till 16.45, room 102 of MENR, except of weekends and national holidays.

Request for information is submitted in a random form.

To submit the written request the requestor can use the form given in the reception room or on the official web site of the Ministry.

Request for information should contain the following:

- family name, name, patronymics (name) of requester, mail address, address of electronic mail or number of communication means (if any);

- general description of information or type, name, details or content of document, with regard to which the request was made (if it is known to requester);

- signature and date (provided that the written request is submitted).

Request for information can be handed over personally to the Ministers within office hours under the rules of internal order.

In case when for grounded reasons (disability, limited physical capacities etc.) the person is unable to submit the request the such request is formalized by employee of reception-room of the Ministry specifying family name, name, patronymics, contact telephone and provides the requester with copy of such request.

In case when a request for information concerns information required to protect life or freedom of person, information on status of environment, quality of foodstuff and household articles, accidents, catastrophes, hazardous natural events and other emergencies, which have occurred or may occur and jeopardize security of citizens then the response is provided within 48 hours from the day of receipt of request.

In case the request concerns provision of a bulk information or requires searching the information among large volume of data, then the period of consideration of the request can be prolonged up to 20 working days justifying such prolongation. The requester shall be informed, in writing, about prolongation of such period not later than within five working days from the day of receipt of such request. 

Information for request is provided for free.

In case the requested information contains documents with a volume exceeding 10 pages then the requester should reimburse the actual copying and printing costs in accordance with the Resolution of the Cabinet of Ministers of Ukraine of 13.07.2011 # 740 “On Adoption of the Maximal Permissible Norms of Costs for Copying or Printing of Documents Being Provided upon Information Request”. Such notification is given, within five working days from the day of receipt of request, to requester specifying the volume of actual costs related to copying or printing of documents, details and procedure of reimbursement of such costs. Information is provided after the payment of actual costs is confirmed.

 The information can be not provided according to the request in the following cases:

- MENR does not possess and is not obliged to, under its competence stipulated by legislation, possess the information that is being requested; - information being requested is within the category of information with limited access;

- requester did not pay for actual costs related to copying or printing of documents;

- the requirements to making and submitting the request for information stipulated by part five Article 19 of the Law of Ukraine "On Access to Public Information" were not met, namely, the following was not indicated:

Name, family name, patronymics (name) of requester, mail address or electronic address as well as number of communication means (if any);

General description of information or type, name, requisites or content of document with regard to which the request was made (if requester is aware of);

Signature and date (provided that written request is submitted).
